4.1 Free Tier: New users receive 10 free queries per month. Free accounts are subject to usage limits and may have restricted features.

4.3 Billing: By providing payment information, you authorize us to charge the applicable fees to your payment method. You are responsible for all charges incurred under your account.
4.4 Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.

7.2 User Content: You retain ownership of the queries you submit to the Service. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your queries to provide and improve the Service.
7.3 AI-Generated Content: Responses generated by the Service are provided for your personal use. You may not claim ownership of AI-generated content or use it in ways that violate applicable laws or third-party rights.
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy.

9.4 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, OHMYGAWD, CYBERNETIX TECHNOLOGIES, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
9.5 Maximum Liability: IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless OhMyGAWD, Cybernetix Technologies, and their affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any security breach or unauthorized access resulting from your actions or negligence.
11.1 Termination by You: You may terminate your account at any time by contacting us or using the account deletion feature in your profile settings.
11.2 Termination by Us: We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice, including for violation of these Terms.
11.3 Effect of Termination: Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
12.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Cybernetix Technologies operates, without regard to its conflict of law provisions.
12.2 Arbitration: Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.
12.3 Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, and there is no right or authority for any dispute to be arbitrated on a class-action basis.
13.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and OhMyGAWD regarding the Service and supersede all prior agreements.
13.2 Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
13.3 Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
13.4 Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
13.5 Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
